Take-Down Policy

The Worcester Art Museum makes every effort to ensure that it has appropriate rights to ingest and provide access to content. In those cases where the rights are unclear (e.g., when we encounter copyright information that, relative to the work in hand, is ambiguous or contradictory), we archive but do not provide access to the work. Where possible, the Worcester Art Museum secures rights to use works that are in copyright. Parties who have questions or who wish to contest the use of specific works may contact the Curatorial department at collectionsandexhibitions@worcesterart.org or:

Worcester Art Museum
ATTN: Rights & Permissions
55 Salisbury Street
Worcester, MA 01609

With all such communications, please include:

  1. A physical or electronic signature of the copyright owner. NOTE: If an agent is providing the notification, also include a statement that the agent is authorized to act on behalf of the owner
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Library to locate the material. Providing URLs in your communication is the best way to help us locate content quickly.

The Museum will respond to all correspondence within two-three business days upon arrival. If the Museum is not able to determine, within the specified time frame, that the Museum is permitted to use the work(s) in question, the Museum will cease providing access to the work until or unless it can determine that such uses are permitted. The Museum may work with the Worcester Art Museum’s General Counsel to make determinations about appropriate use. Depending on these determinations, the Library may restrict access to the work(s) in question or remove them from its systems.

ACCEPTANCE OF TERMS AND CONDITIONS:

BY ACCESSING THIS WEBSITE, INCLUDING THE USE OF ANY IMAGES OR CONTENT, YOU ACCEPT WITHOUT LIMITATION OR QUALIFICATION THESE TERMS AND CONDITIONS OF USE.  THE WORCESTER ART MUSEUM MAY REVISE THESE TERMS AND CONDITIONS OF USE AT ANY TIME, AND SUCH REVISIONS SHALL BIND YOU. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, PLEASE EXIT THE SITE NOW AND REFRAIN FROM FURTHER USE.

Collection Integrity

All information provided on our website is compiled with the utmost care and accuracy. Items available through the Collection Search are approved for public access only on the basis of accurate information for scholarly purposes. Our site is ever-expanding as further research discoveries develop, so please understand that we try to provide access to as much of our Permanent Collection as we are able.

Collection Copyright

The Worcester Art Museum strives to distribute as much educational knowledge as possible through its Permanent Collection. The Museum has the power to grant and deny permissions to reproduce images of artworks in the Permanent Collection to the extent where ownerships rights are held. Other works of art, including photographic representations of them, are potentially protected under copyright not owned by the Worcester Art Museum. Responsibility for obtaining rights and permissions from these copyright holders falls on the applicant. Once granted permissions are obtained from these outside parties, copies of the approvals must be sent to Worcester Art Museum in order to advance image use requests. The Worcester Art Museum assumes no responsibility for any royalties or fees claimed by the copyright holder.

All photographs of art objects in the Worcester Art Museum’s Permanent Collection, and available through our Collection Search, are the sole artistic renderings of our staff photographers, and the Museum holds copyright on their use, unless otherwise noted. Permission to reproduce works, whether in print media or any electronic media format, or any future technologies not in current use, must be obtained by the Registrar’s Department. The museum reserves the right to grant approval and to collect reproduction fees it deems appropriate. Any unauthorized use by any person or entity will render them responsible and liable to the museum for appropriate compensation and other costs.

Fair Use Exception

The Worcester Art Museum supports and promotes educational development and expansion of knowledge. Therefore, we do not object to the downloading, use, distribution and transmission of our content/images if done in accordance with 17 U.S.C. §107 (“Fair Use”), 17 U.S.C. §110 (“the Teach Act”), or other applicable limitations and exemptions set forth in the U.S. Copyright Act and related laws. We require that a credit line be included with an image if used in a projection lecture or online educational format. Please include the proper credit line for the specific art object used. Example: “Image © Worcester Art Museum, Bequest of Reverend Thadeus Clapp.” [See directions below to properly located credit lines]

Worcester Art Museum Photography and Video Policy

Non-flash photography and video capture is permitted within the Museum, for personal, non-distributional, noncommercial use only. For the safety of the art and Museum visitors, the use of any form of a tripod, selfie sticks, or other camera equipment (including drones) within the Museum is not allowed, unless permission is specifically prearranged. Please note: There may be select exhibitions for which photography of any kind is not allowed. These exceptions are noted on each exhibition page.
